15 clauses. Open one, or open all of them and read it straight through.
01This agreementWho these terms are between, and when they start applying to you.
These terms are an agreement between you and ANA BOOKKEEPING SERVICES LTD ("we", "us", "our"), which operates Yearcard at anabookkeepingshetland.com. They apply from 20 August 2026.
By creating an account, or by using the service, you agree to these terms. If you do not agree to them, do not use the service.
You can contact us at any time at support@anabookkeepingshetland.com, on +44 7567524998, or at Top Floor, The Garret, Esplanade, Lerwick, Shetland, Scotland ZE1 0LL.
If any part of these terms is found to be unenforceable, the rest continues to apply.
02What this service is, and what it is notA design tool for turning numbers you type into cards and short films. Nothing more.
Yearcard takes business figures that you type in yourself and turns them into a set of visual cards and, on a paid plan, a short silent film built from those cards.
It does not connect to any accounting system, bank, ledger or bookkeeping software, and it does not read any of your financial records. Every figure it displays was typed by you.
It is not a bookkeeping, accounting, audit, tax, financial advice, investment or business advisory service. It does not analyse your performance, does not evaluate your results, and holds no benchmark or industry-average data of any kind. It will never tell you that a figure is good, bad, healthy, above average or below average, because it has no basis on which to say so.
Nothing produced by this service is financial advice, investment advice, a business recommendation, or a representation about your business made by us. What a card says is what you told it to say.
03Your account and your ageYou must be 18 or over, one account per person, and you look after your password.
You must be at least 18 years old to create an account or to hold a subscription. This service is intended for people running a business and is not directed at children.
You are responsible for keeping your password secret and for everything done through your account. Tell us straight away if you think someone else has access to it.
The information you give us when you register must be accurate, and you must keep it up to date.
We may suspend or close an account that is being used in breach of these terms or our acceptable use policy. Where we do, we will tell you why, unless telling you would itself be unlawful.
04Plans, prices and automatic renewalWhat you are charged, when, in what currency, and how the renewal works.
There is a free plan, and there are paid plans. The price, the billing period and the monthly allowance of each plan are shown on the pricing page and again on the checkout page before you pay.
All prices are in United States dollars (USD). Where tax applies to your purchase it is calculated and shown before you confirm, and is added to the price shown.
A paid plan renews automatically. At the end of each billing period we charge the same payment method again, for the same plan, at the price then shown on the pricing page, and a new period begins. This continues until you cancel. We will tell you the date of your next renewal before you first pay, and it is shown on your billing page at all times.
If we change the price of a plan you already hold, we will email you at least 30 days before the change takes effect. You can cancel before that date if you do not want to continue at the new price.
Payment is taken by our payment provider. We do not receive or store your full card number.
05Your allowanceCredits are a usage allowance. Not money, not stored value, not refundable in cash.
Each plan includes a monthly allowance, counted in credits. Different operations consume different amounts, and the current rates are published on the pricing page and inside the product.
Credits are an allowance for using this service and nothing else. They are not money, not a currency, not stored value, not a prepaid balance and not a financial product. They cannot be exchanged for cash, cannot be withdrawn, cannot be sold and cannot be transferred to another person or account.
Credits are issued by us and accepted only by us, for use only within this service.
Each period's allowance is for that period. Any part of it that is unused when the period ends does not carry over into the next period.
There are no credit packs and no way to buy additional credits. If your allowance runs out before the period ends, the only route is to move to a higher plan, which you can do at any time.
If an operation fails through a fault on our side, the credits it consumed are restored to your allowance.
06Cancelling, and your right to change your mindOne button in your account. Plus the statutory 14-day right when you first subscribe.
You can cancel a subscription at any time from the billing page inside your account. It is a button on that page, followed by one confirmation. We do not require you to call us, email us, chat to anyone, or work through a sequence of offers.
Cancelling stops the next renewal. Your plan stays active, and your allowance stays usable, until the end of the period you have already paid for. We do not refund the remainder of a period that has already begun, except where the law requires it or where our refund policy says otherwise.
Separately, as a consumer buying at a distance you normally have 14 days from the day the contract is made to change your mind and withdraw from it, without giving a reason.
Because this service is delivered immediately, when you subscribe you are asked to confirm that you want it to start straight away. If you then withdraw within the 14 days, you are charged a proportionate amount for the part of the period that had already run, and the rest is refunded to you.
To withdraw, tell us in any clear statement — email is fine. A standard withdrawal form is available on request and is set out in our refund policy.
We may rescind this agreement, on notice to you, if you materially breach it and do not put the breach right within 14 days of us asking you to. If we do, we refund the unused part of any period you have paid for.
07Your content stays yoursYou own what you type and upload, and what comes out. We get a narrow licence to run the service.
You keep ownership of the figures and words you type, of any files you upload, and of the cards and films produced for you.
You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt and process that material only so far as is necessary to operate the service for you, to keep backups, and to comply with the law. That licence ends when the material is deleted, subject to the retention periods in our privacy policy.
You confirm that you have the right to upload anything you upload, that it does not infringe anyone else's rights, and that where it shows an identifiable person you have that person's permission.
We do not use your material to train, fine-tune or evaluate any machine learning model. This is set out in full in our privacy policy and in our content licence.
08How you may and may not use itThe short version: do not use it to mislead people about your business.
You may use Yearcard for your own business and for the businesses of clients you work for.
You may not use it to present figures you know to be false, to mislead an investor, a lender, a buyer, an insurer or a public authority, to imply a comparison with anyone else's results, or to suggest that this service has verified or audited anything.
The full list of prohibited uses is in our acceptable use policy, which forms part of this agreement.
You may not attempt to reverse engineer, resell, sublicense or scrape the service, or to bypass its metering.
09Generated materialVisual output varies. Numbers do not, because we do not generate them.
Card visuals and films are produced by machine learning models. Their output varies, is not guaranteed, and may not be unique — another user giving a similar direction may receive something similar.
The models are never given your figures. Every digit, every quoted phrase and every instruction about type is removed from the prompt before it is sent, and all text and numbers on a finished card are drawn afterwards by your browser from exactly what you typed.
You are responsible for the accuracy of the figures themselves. We show you a proofing screen comparing what you typed against what appears on each card, and you must pass it before you can export anything, but only you can know whether the figure you typed is the right one.
Our AI disclaimer sets out the limits of generated material in full, and forms part of this agreement.
10AvailabilityWe aim to keep it running. We do not promise it will never be down.
We work to keep the service available, but we do not guarantee that it will be uninterrupted or error-free. We may take it down for maintenance, and we will give notice where we reasonably can.
We may change or withdraw features. If we withdraw something material that you are paying for, you may cancel and we will refund the unused part of the period you have paid for.
11Our liability to youWhat we are responsible for, and the limits — none of which cut into your statutory rights.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking this agreement or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
Subject to the paragraph above, our total liability to you in connection with this agreement in any twelve month period is limited to the greater of the amount you paid us in that period, or fifty United States dollars.
We are not liable for business losses. If you use the service for any commercial purpose we will have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
Nothing in this agreement affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 to services carried out with reasonable care and skill.
12Governing law and jurisdictionThe law of Scotland, and a non-exclusive jurisdiction that keeps your home-country rights intact.
Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the law of Scotland.
The Scottish courts have non-exclusive jurisdiction. Nothing in this clause affects your right, as a consumer, to bring proceedings in the courts of the country where you are resident, or to rely on mandatory consumer-protection rules of that country.
13Time limits for court actionFive years in Scotland, under the 1973 Act. This is a limitation period, not a warranty.
Your statutory rights under the Consumer Rights Act 2015 are not limited to a fixed number of years.
Separately, under the Prescription and Limitation (Scotland) Act 1973, a claim in the Scottish courts must generally be raised within five years. In England and Wales the equivalent period is six years.
This is a limit on how long you have to raise a claim in court. It is not a warranty period, and it is not a point after which we stop being responsible for something we did.
14If something goes wrongTalk to us first. Then, if you need to, the routes that are open to you.
The fastest route is always to email support@anabookkeepingshetland.com with your account email and what happened. We answer every message, and most problems are settled that way.
If you are resident in Scotland and your claim is for £5,000 or less, you may be able to use Simple Procedure in the Sheriff Court. This is designed to be used without a solicitor.
Consumer help
If you live in Scotland, free advice is available from consumeradvice.scot, funded by the Scottish Government. This service is available to Scottish residents only. Consumer Scotland is the statutory consumer body, and Trading Standards Scotland handles enforcement.
If you live outside Scotland, you can contact the consumer advice body in your own country, and the mandatory consumer-protection rules of your country of residence continue to apply to you.
15Changes to these termsNotice before a material change, and a way out if you do not accept it.
We may update these terms. If a change is material we will email everyone with an account at least 14 days before it takes effect.
If you do not accept a material change, you may cancel before it takes effect and we will refund the unused part of any period you have already paid for.
Continuing to use the service after a change takes effect means you accept the updated terms.
